TERMS AND CONDITIONS OF BUSINESS

1. About Us

www.isokernshop.co.uk (“Website”) is operated by BMF Limited, a company registered in England and Wales under company number 05238759, with registered office at Techno Centre, Station Road, Horsforth, Leeds, LS18 5BJ (“we”, “us”, “our”).  VAT registration 852975876

2. Definitions

• “Consumer” means an individual purchasing goods for personal use and not for resale.
• “Goods” means products offered for sale on our Website, including Isokern products and accessories.
• “Contract” means the legally binding agreement between you and us for the sale of Goods.

3. How the Contract is Formed

When you place an order you will receive an acknowledgement email – this is not acceptance. The contract is formed only when we dispatch the Goods and send you a dispatch confirmation email. We may refuse any order (stock, pricing errors, legal reasons, etc.).

4. Product Information

We take care to ensure descriptions, images and specifications are accurate, but images are for illustration only and measurements/performance data are provided in good faith.

5. Prices and Payment

Prices include VAT unless stated otherwise. Delivery charges are shown at checkout. Payment is taken at time of order. We are not obliged to honour obvious pricing errors.

6. Delivery

• Standard delivery is mainland UK only (unless otherwise agreed)
• Delivery dates are estimates, not guaranteed
• Many items are palletised – suitable access required
• Risk passes to you on delivery; title passes on full payment

7. Damage or Shortage on Delivery

You must inspect Goods immediately on receipt and report any visible damage or shortage within 24 hours with photos to [email protected]. Late notification may affect your claim.

8. Your Right to Cancel (Consumer Contracts Regulations 2013)

You have 14 days from receipt to cancel for any reason.

• Notify us in writing (email accepted) to [email protected]
• Return Goods within 14 days of notification
• Goods must be unused and resaleable
• Return postage is your responsibility unless the item is faulty/incorrect

Returns Outside the 14-Day Period

We may accept returns at our discretion after 14 days, subject to a 35% restocking fee. Goods must be unused and in a resaleable condition. Return shipping remains your cost.

9. Refunds

Refunds are processed within 14 days of receiving returned Goods using the original payment method. We may deduct for loss in value, premium delivery costs, failed collections or restocking fees. Bespoke/made-to-order items are non-refundable unless faulty.

10. Faulty or Non-Conforming Goods

Your full statutory rights under the Consumer Rights Act 2015 apply. Faulty or misdescribed items may be repaired, replaced or refunded. Damage from misuse or incorrect installation is excluded.

11. Warranty

Manufacturer warranties apply where offered. They require correct installation and use.

12. Installation & Safety

Most Isokern products must be installed by a qualified professional. We accept no liability for incorrect installation or non-compliance with building regulations.

13. Limitation of Liability

We are not liable for installation errors, indirect/consequential loss, business losses or failure to follow instructions (except where law prohibits exclusion, e.g. death/personal injury).

14. Force Majeure

We are not liable for delay or failure caused by events beyond our reasonable control.

15. Privacy & Data Protection

Personal data is handled in accordance with our Privacy Policy, UK GDPR and the Data Protection Act 2018.

16. Complaints

Please email [email protected]. Unresolved issues may be escalated to an independent ADR entity.

17. Governing Law

English law applies. English courts have exclusive jurisdiction.
